FlyNest Terms of Use

These terms govern your use of FlyNest, an iPhone app published by Le Super Cent (“we”, “us”). By downloading or using FlyNest you agree to them. If you don't agree, please don't use the app. Questions: cyndie@lesupercent.com.

The short version

1. What FlyNest is — and isn't

FlyNest offers tools to help with the fear of flying: guided meditations, breathing exercises, articles, a pre-flight checklist, an in-flight tracker and an AI Captain. It is designed for general wellbeing and education.

FlyNest is not a medical device and does not provide medical, psychological or therapeutic advice, diagnosis or treatment. If your anxiety seriously affects your life, please consult a qualified professional; cognitive behavioural therapy and exposure therapy have strong evidence behind them. If you are in crisis or feel unsafe, contact your local emergency services.

2. Who can use FlyNest

You must be at least 16 years old, or the age of digital consent in your country if higher, and able to enter into a binding agreement. You use FlyNest on an Apple device you own or control, in line with Apple's Usage Rules.

4. The AI Captain

The AI Captain generates answers on your iPhone using Apple Intelligence. Its answers are automatically generated, general in nature and may be incomplete or inaccurate. They are not professional advice of any kind. In the air, the instructions of your cabin crew and pilots always prevail. Don't rely on the AI Captain for decisions about your health or safety.

5. Flight tracking and maps

Positions, progress, remaining time and maps in FlyNest are estimates based on your flight details, the timetable and, when available, your phone's GPS. They can be inaccurate or delayed and must never be used for navigation, safety or operational decisions. Map data © OpenStreetMap contributors.

7. Ownership and licence

FlyNest, its design and its content belong to Le Super Cent or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use FlyNest on Apple devices you own or control, for your own non-commercial use, in line with these terms and Apple's Licensed Application End User License Agreement, which also applies.

How we handle your data is explained in our Privacy Policy, which is part of these terms.

9. Third-party services

FlyNest relies on services such as Apple (App Store, Apple Intelligence), RevenueCat and Superwall (subscriptions), Mixpanel (analytics), AppsFlyer (ad measurement) and Cloudflare (maps). Their availability is not under our control.

10. Apple

These terms are between you and Le Super Cent, not Apple. Apple is not responsible for FlyNest or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to FlyNest. If FlyNest fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes and availability

We improve FlyNest regularly: features and content may change, be added or be removed. We may update these terms; if the changes are significant we'll tell you in the app, and the new version applies from its effective date. Continuing to use FlyNest after that date means you accept the updated terms.

12. Disclaimers and liability

FlyNest is provided “as is” and “as available”. To the extent permitted by law, we don't guarantee that it will be uninterrupted, error-free or meet every expectation, and we are not liable for indirect or consequential losses arising from its use. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

13. Ending

You can stop using FlyNest at any time and delete your data from FlyNest › You › Settings › “Delete my account” (this doesn't cancel your App Store subscription: see section 3). We may suspend access if you seriously breach these terms.

14. Law and disputes

These terms are governed by French law, without depriving you of the mandatory protections of the law of the country where you live. Before any formal action, please contact us so we can try to resolve the issue. EU consumers may also use a consumer mediator or the courts of their place of residence.
